Terms and Conditions of Participation in the “OCB Creators” program

These Terms and Conditions (hereinafter, the “Terms”) are intended to regulate the process by which individuals of legal age (hereinafter, the “Participant”) may apply to be selected to take part in the “OCB Creators” program.

 

OCB Creators is managed by the agency Common Sense Soluciones de Comunicación, S.L. (hereinafter, the “Agency”), on behalf of Republic Technologies International S.A.S., owner and licensee of the “OCB” brand (hereinafter, “RTI”), with the purpose of establishing occasional collaborations for the promotion of the “OCB” brand. The Agency shall act as RTI’s representative for all activities related to this program, including the receipt of applications, the selection process, and the management of collaborations resulting from such selection.

 

1. Voluntary and Non-Binding Participation

To participate in “OCB Creators”, individuals must be at least 18 years of age and hold an active and publicly accessible social media account. The Agency reserves the right to request additional documentation in order to verify the Participant’s age and ownership of the social media accounts.

 

Participation in “OCB Creators” is entirely voluntary. Submitting a proposal does not imply automatic acceptance nor guarantee any future collaboration. Only the selected profiles will be contacted. No individual response will be provided to all submissions received, nor will the reasons for non-selection be disclosed.

 

The Agency shall be responsible for receiving and managing the proposals submitted through the form. Only the profiles selected will be contacted by the Agency on behalf of RTI.

 

2. Selection Criteria

Profiles will be selected by the Agency and RTI based on qualitative criteria, including the style and tone of the content, alignment with the brand’s values, audience, originality, and creative potential. The decision shall be discretionary, final, and not subject to appeal, review, or negotiation. The Agency and RTI reserve the right to reject any application at their sole discretion, without the obligation to provide justification for their decision.

 

3. Use of Submitted Information

The information and materials shared through the form or in subsequent conversations with the Participant shall be treated confidentially by the Agency and RTI. No content will be published or disclosed without prior agreement with the creator. If no contact is established within a reasonable period of one (1) calendar month, the content related to the application will be deleted from our systems.

 

The personal data provided as part of the application will be processed by the Agency in accordance with Clause 8 and RTI’s Privacy Policy. By submitting your application, you acknowledge and agree that the Agency and RTI may retain the submitted information for as long as necessary to evaluate your candidacy. Unless expressly agreed otherwise, the submission of content as part of the application shall not give rise to any right to financial or other compensation, in accordance with Clause 5 of these Terms.

 

By submitting an application to “OCB Creators”, the Participant warrants that the content provided, including texts, images, videos, and any other material (hereinafter, the “Content”), is their own creation and does not infringe the rights of third parties, including copyrights, trademarks, privacy rights, or any other rights. Should the Agency determine that the Content infringes third-party rights, participation shall be automatically rejected.

 

4. Collaboration Modality

All collaborations shall be occasional in nature and shall not constitute an employment relationship, an ongoing commercial relationship, or a commitment of continuity. The specific conditions of each collaboration (format, deadlines, type of content, etc.) shall be defined individually through a written agreement with each creator.

 

The written collaboration agreement shall specify the terms governing the use and transfer of intellectual property rights of the content generated in favor of RTI, including terms of use, duration, territorial scope, and any other applicable conditions.

 

Neither the Agency nor RTI shall be liable for delays, breaches, or issues arising from the creator’s failure to comply with the specific conditions agreed upon for each collaboration, and they reserve the right to annul or cancel such collaboration without giving rise to any right of compensation for the creator.

 

5. Compensation and Recognition

In most cases, the collaboration will consist of publishing the content through the official social media channels of the “OCB” brand, mentioning the creator and providing visibility to their profile and work.

 

Any other type of financial or material compensation shall be considered individually and on an exceptional basis, and shall be subject exclusively to the discretion of RTI and the Agency, and reflected in the specific collaboration agreement. In the absence of such agreement, it shall not be understood that RTI or the Agency have any obligation to provide compensation.

 

6. Code of Conduct

The Agency and RTI operate in accordance with the principles of the International Council for Advertising Self-Regulation (ICAS), an international body that promotes ethical standards in commercial communication based on the International Chamber of Commerce (ICC) Advertising and Marketing Communications Code.

This entails a commitment to honest, lawful, socially responsible, and respectful communication in all markets where the brand is present. Therefore, Participants in this initiative commit to:

  • Refrain from disseminating messages that may mislead or be deceptive, whether in relation to the brand or its products.
  • Not direct their content, either directly or indirectly, at minors, nor promote irresponsible uses or uses not permitted under the laws of their country.
  • Not link the content to situations involving risk, illegality, antisocial behavior, violence, or discrimination of any kind.
  • Avoid any communication that may be considered offensive, inappropriate, or in conflict with the values of the “OCB” brand or RTI.

Furthermore, the Participant must comply with RTI’s Code of Conduct, available on its official website: Code of Conduct. Participation in the “OCB Creators” program constitutes the express acceptance of said Code of Conduct and the commitment to act in accordance with its principles throughout the relationship with the Agency and RTI.

 

The Agency and RTI will particularly value Participants and creators who integrate these principles into their usual editorial line and promote a respectful, creative, and mindful digital presence.

The Agency and RTI reserve the right to review any content related to the collaboration at any time and request modifications or removal if they deem it non-compliant with the principles set forth in this Code of Conduct.

 

7. Reputation and Termination Clause

The Agency and RTI reserve the right to immediately cancel any collaboration if the creator publishes content that may harm the image of the brand or of third parties, including competitors in the sector, or engages in behavior that conflicts with the values of the “OCB” brand.

 

Behaviors that may result in the immediate termination of the collaboration include, but are not limited to: the publication and dissemination of offensive, discriminatory, violent, illegal content, or content contrary to public order and applicable regulations, including those governing social media; defamatory statements regarding the “OCB” brand or products, or third parties; and any action that may damage the image of the “OCB” brand or the reputation of RTI or the Agency.

 

8. Data Protection

In compliance with Regulation (EU) 2016/679, General Data Protection Regulation (“GDPR”), and other applicable regulations, the Participant is informed that the personal data provided within the framework of the “OCB Creators” program will be processed by Common Sense Soluciones de Comunicación, S.L., with registered address at Carrer de Ramon Turró, 169, 08005 Barcelona, Spain, and CIF (Tax ID) B25598996, acting as a subcontractor of Republic Technologies International S.A.S., for the purpose of managing the Participant’s application, conducting the selection process, and, if applicable, coordinating collaborations with the selected profiles.

 

The data may be communicated to Republic Technologies International S.A.S., the data controller and owner of the OCB brand, solely for the purpose of evaluating profiles, validating collaborations, and ensuring compliance with RTI group values, guidelines, and internal policies.

 

The legal basis for processing is the contractual execution of these Terms and Conditions accepted by the Participant upon submitting their application.

 

By participating in the program, the Participant declares that they have read and accepted RTI’s Data Protection Policy, available at: Privacy Policy. Data will be retained only for as long as necessary to fulfill the purposes described above, and, if applicable, for the legally required periods.

 

Participants may exercise their rights of access, rectification, erasure, restriction of processing, objection, and data portability by contacting in writing the subcontractor Common Sense Soluciones de Comunicación, S.L. at ocbcreators@commonsense.es, or by postal mail to the address indicated. They may also contact the Data Protection Officer (DPO) of the RTI group for any questions, difficulties related to the management of their data, or to exercise their rights via email at privacy@rpb-tech.com or by postal mail addressed to:

The DPO undertakes to respond to any request within a maximum period of one (1) month from its receipt. Additionally, the Participant has the right to lodge a complaint with the competent data protection authority, in particular the Spanish Data Protection Agency (www.aepd.es) or another competent authority depending on their place of residence.

 

9. Acceptance of the Terms

Submitting the form constitutes full acceptance of these Terms and Conditions. The Agency and RTI reserve the right to modify them at any time, updating this page in the event of changes.

 

10. Applicable Law and Jurisdiction

These Terms shall be governed by the laws of Spain. Any dispute relating to these Terms or to the “OCB Creators” program shall first be attempted to be resolved amicably between the parties. If no agreement is reached, any dispute shall be resolved exclusively by the courts of Barcelona.
